On Wednesday, June 9, DuPage County State’s Attorney Robert Berlin announced that Kelvin Brown, 42, believed to be homeless with a last known address in Bellwood, appeared in court where he entered a plea of not guilty to one count of Aggravated Battery (Class 3 Felony) and two counts of Public Indecency (Class 4 Felony). On May 7, 2021, Brown appeared in Bond Court where Judge Brian Diamond set bond at $25,000 with 10% to apply, in accordance with a previously issued arrest warrant. He has remained in custody at the DuPage County Jail since that time.
On Thursday, May 27, a DuPage County Grand Jury returned a three-count indictment against Brown. The indictment alleges that on Saturday, April 10, Brown “made physical contact of an insulting and provoking nature with” the victim in that he grabbed the victim’s buttock while at the Fitness Formula Club on Addison Avenue in Elmhurst. The indictment also alleges that on Monday, April 12, Brown “performed a lewd exposure of the body…while in a public place” at both the Fitness Formula Club as well as the Elmhurst Public Library.
“The allegations against Mr. Brown are disgusting and will not be tolerated,” Berlin said. “When out in public, people should not have to worry about their personal space being violated, as is alleged in this case.”
Brown’s next court appearance is scheduled for June 28, for a status hearing in front of Judge Jeffrey MacKay.
